Terms of Service

These Terms govern your use of My Digital Sevak (the “Service”), a software product owned and operated by Advance Media Solution (“AMS”, “we”, “us”, “our”). My Digital Sevak is a brand of Advance Media Solution. By creating an account or using the Service, you agree to these Terms.
1.Who can use the Service
You must be at least 18 years old and authorised to enter into this agreement on behalf of your business or agency (“you”, “your”). You are responsible for everything that happens under your account, including the actions of your team members and the clients you invite to the client portal.
2.Your account
- You agree to provide accurate information and to keep your login credentials secure.
- You are responsible for all activity under your workspace.
- Notify us promptly at nishant@advancemediasolution.com if you suspect unauthorised access.
3.Subscriptions, free trial & billing
- Free trial: New workspaces include a 7-day free trial. A valid payment method (card or UPI) is collected at sign-up via our payment processor, but you are not charged during the trial.
- Auto-renewal: Unless you cancel before the trial ends, your selected plan begins and renews monthly automatically until you cancel. Each renewal charges the then-current price for your plan.
- Pricing & taxes: Prices are in Indian Rupees (₹) and are subject to applicable taxes (including GST) as required by law. A GST tax invoice is issued for each charge.
- Plan limits: Each plan includes limits (e.g. number of clients and team seats). Reaching a limit may require upgrading your plan to add more.
- Changes: Upgrades take effect immediately (prorated); downgrades take effect at the end of your current billing period.
- Payments are processed by Razorpay. We do not store your full card details.
4.Cancellation & refunds
You can cancel anytime from the Subscription settings in your dashboard, or by emailing us. Cancellation, refund eligibility and processing are described in our Refund & Cancellation Policy, which forms part of these Terms.
5.Your data & your clients’ data
You own your data. All content you and your clients add to the Service — brands, content calendars, files, invoices, contacts and client information (“Customer Data”) — remains yours. AMS processes Customer Data only to provide the Service to you, acting as your data processor.
- You are responsible for having the necessary rights and consents to upload Customer Data, including any personal data of your clients and their customers.
- You will use the Service in compliance with applicable data-protection laws, including the Digital Personal Data Protection Act, 2023.
- How we handle personal data is described in our Privacy Policy.
6.Acceptable use
You agree not to:
- use the Service for unlawful, fraudulent, or harmful purposes;
- upload malware, attempt to breach security, or access another customer’s data;
- reverse-engineer, resell, or sublicense the Service without our written permission;
- overload or disrupt the Service or its infrastructure.
7.Intellectual property
The Service, its software, design, and brand (including “My Digital Sevak”) are owned by Advance Media Solution. We grant you a limited, non-exclusive, non-transferable right to use the Service during your subscription. You retain ownership of your Customer Data.
8.Third-party services
The Service relies on third-party providers (such as Razorpay for payments, Supabase for hosting/database, Resend for email, Google Drive for file previews, and Netlify for delivery). Your use may be subject to their terms. We are not responsible for third-party services beyond our reasonable control.
9.Availability & support
We work hard to keep the Service available and to maintain regular backups, but we do not guarantee uninterrupted or error-free operation. We may perform maintenance, occasionally with downtime. Support is available at nishant@advancemediasolution.com.
10.Suspension & termination
- We may suspend or terminate access for non-payment, breach of these Terms, or misuse.
- You may stop using the Service at any time by cancelling your subscription.
- On termination, you may request an export of your Customer Data within 30 days, after which it may be permanently deleted.
11.Disclaimer
The Service is provided “as is” and “as available”, without warranties of any kind, express or implied, to the maximum extent permitted by law.
12.Limitation of liability
To the maximum extent permitted by law, AMS will not be liable for any indirect, incidental, or consequential damages, or for loss of profits, data, or goodwill. Our total liability for any claim relating to the Service is limited to the amount you paid us for the Service in the three (3) months preceding the claim.
13.Indemnity
You agree to indemnify and hold AMS harmless from claims arising out of your Customer Data, your use of the Service, or your breach of these Terms.
14.Changes to these Terms
We may update these Terms from time to time. Material changes will be notified by email or in-app. Continued use after changes take effect constitutes acceptance.
15.Governing law & jurisdiction
These Terms are governed by the laws of India. Any disputes are subject to the exclusive jurisdiction of the courts at Rudrapur, Uttarakhand.
